The Parks Director for the City of Chelan left employment with the City of Chelan in April of 2006. A result may have been that the City of Chelan dropped the ball on scheduling and coordinating City facilities.
Inexplicably to us, the City of Chelan revoked a previously issued Special Use Permit midway through the Lake Chelan Triathlons in July of 2006. At that time we did everything in our power to comply with permit requirements and took extra steps to satisfy all safety concerns.
We were able to successfully have three days of triathlon events prior to the City of Chelan’s actions.
We believe the City of Chelan breached a written agreement we had to operate the 2006 Lake Chelan Triathlons. We speculate that because of the successful operation of prior triathlons by us, the City or other entities may have wanted to “take over” the event for future years. Unfortunately, a result of the City of Chelan’s actions was to deprive you of the opportunity to participate in the triathlon.
At this time we are pursuing a claim with the City of Chelan to include entry fees. We hope to be able to then be able to make good on all event entry fees for those whose participation was cut short by the City of Chelan. Unfortunately, in an attempt to resolve the revoked City of Chelan Special Use Permits, we were forced to retain counsel to try to work with the City. That forced us to incur unbudgeted expenses. Therefore, at this time, we are not in a position to refund any more entry fees. But, we are exploring various ways to allow credit for future events or deferred payments. In the event we are successful in our claim with the City of Chelan for the breach of an agreement to allow us to operate the triathlon, we hope to be able to reimburse entry fees for participants who were denied the opportunity to participate. None of your entry fees have gone towards the legal fees, these have been covered by sponsors.
We are fully aware of how much grief the short notice cancellation of this event by the City of Chelan has caused you and your family. We understand and appreciate the efforts that went into training and making arrangements to participate in the event. Hopefully, that momentum will carry you to other events.
We do hope you continue your training and look forward to seeing you in the future.
